Private party vehicle purchases are common in Indiana and can offer significant price advantages compared to dealer inventory. They also come with meaningfully fewer consumer protections and a different set of risks that buyers need to understand before handing over money for a vehicle whose history they may not be able to fully verify.
No Implied Warranty in Private Sales
Indiana private party vehicle sales are as-is transactions. The seller has no obligation to disclose known defects, and you have no recourse under Indiana's lemon law, which applies only to dealer sales. If the engine fails two weeks after purchase and the seller did not disclose a known problem, you have limited options unless you can prove intentional fraud, which is difficult and expensive to litigate.
Pre-Purchase Inspection Is Non-Negotiable
Given the absence of consumer protections in private sales, a pre-purchase inspection by an independent mechanic is not optional, it is essential. Expect to pay $100 to $150 for a qualified mechanic to inspect the vehicle on a lift. A seller who refuses to allow a pre-purchase inspection is a seller you should walk away from. There is no legitimate reason for a private seller to decline this request.
Title Transfer and Tax in Indiana
In a private party sale, the seller endorses the back of the title and provides it to you. You have 31 days to register the vehicle at your county BMV office, pay the 7 percent Indiana sales tax based on the purchase price, and receive new plates and registration. Note that private party sales do not qualify for the trade-in tax credit since you are not trading anything, you are simply purchasing.
Outstanding Liens
If the seller has an outstanding loan on the vehicle, the lender holds the physical title and will not release it until the loan is paid. Never pay a private seller for a vehicle with an outstanding loan without arranging simultaneous payoff through an escrow or by handling the transaction at the lender's office. Paying for a vehicle before the lien is released puts you at serious risk of not receiving a clean title.
